Terms of Service

These Terms of Service apply to your use of laima.ca (the "Site") and to any purchase from Laima ("we", "us", or "our"). Laima is a sole proprietorship owned and operated by Jorawar Kahlon in Ontario, Canada. By using the Site or placing an order, you agree to these terms. Please read them along with our Privacy Policy, Return and Refund Policy, and Shipping Policy, which form part of these terms.

1. Eligibility

You must be at least the age of majority in your province, territory, or state of residence to place an order, or have the permission of a parent or guardian.

2. Products

Laima sells non-prescription sunglasses. We make reasonable efforts to show product colours, sizes, and details accurately. Colours may look different depending on your screen. Frame measurements are listed on each product page, and we recommend checking them before you order.

We may change, discontinue, or limit the quantity of any product at any time.

3. Product use and safety

Our sunglasses are designed for everyday sun protection. They are not safety glasses and do not protect against impact. Do not look directly at the sun or a solar eclipse while wearing them, including with UV400 or polarized lenses. Sunglasses are not suitable for night driving.

4. Face shape guide

The face shape guide on our Site offers general style suggestions only. It does not guarantee fit or how a frame will look on you.

5. Pricing and taxes

All prices are listed in Canadian dollars (CAD) unless shown otherwise at checkout. We are not currently registered for GST/HST, so no sales tax is added to your order. Shipping is charged separately and shown at checkout before you pay.

For orders shipped to the United States, Laima prepays applicable import duties. You will not be charged duties at delivery.

If a product is listed at an incorrect price because of an error, we may cancel the order and issue a full refund, even after the order is confirmed. We will contact you before doing so.

6. Orders and payment

When you place an order, you will receive an email confirming that we received it. This confirmation does not mean the order is accepted. A contract of sale is formed when your order ships.

Payment is processed securely at checkout by our payment providers. We do not store your full card details. Payment must be received in full before an order ships.

We may refuse or cancel an order if a product is unavailable, if we cannot verify payment, or if we reasonably suspect fraud. If we cancel after payment, we will issue a full refund.

7. Discount codes and promotions

Discount codes are limited to one use per customer unless stated otherwise and cannot be combined with other offers. The first-order discount is for customers who have not previously ordered from Laima. Codes have no cash value and cannot be applied to past orders. We may change or end a promotion at any time.

8. Shipping

We ship to addresses in Canada and the United States. Delivery times, costs, and responsibilities are described in our Shipping Policy.

9. Returns and refunds

Returns, refunds, and defective items are handled under our Return and Refund Policy.

10. Email and marketing

If you sign up for our email list, we may send you offers and updates. You can unsubscribe at any time using the link in any marketing email. Order confirmations and shipping updates are not marketing and will still be sent.

11. Reviews and customer content

If you submit a product review, you confirm that it reflects your own experience and does not contain unlawful or offensive content. You give us permission to display, reproduce, and share the review on our Site and social media. We may remove reviews that break these terms.

12. Intellectual property

All content on the Site, including images, text, logos, videos, and designs, belongs to Laima or its content suppliers and is protected by Canadian and international law. You may not copy, reproduce, or use any content without our written permission.

13. Prohibited uses

You may not use the Site for any unlawful purpose, to interfere with its operation, to access it by automated means without permission, or to misuse discount codes or promotions.

14. Third-party services and links

The Site uses third-party services such as Shopify, payment processors, and shipping carriers. The Site may also link to other websites. We are not responsible for the content or practices of third-party sites.

15. Disclaimer

The Site is provided on an "as is" and "as available" basis. We do not promise that the Site will always be available or free of errors. This section does not affect any warranties or rights that you have under applicable consumer protection law and that cannot be excluded.

16. Limitation of liability

To the extent permitted by law, Laima is not liable for indirect, incidental, or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law.

17. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer, you may also have rights under the laws of your own province, territory, or state, and nothing in these terms removes those rights.

18. Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with a new effective date. The terms in effect when you place an order apply to that order.
